Gaijin Guidelines for Content Creators

AT GAIJIN, WE ENCOURAGE CREATIVITY AMONG USERS AND ASK ALL CONTENT CREATORS (“CREATORS”) TO REVIEW AND COMPLY WITH THESE GUIDELINES (“GUIDELINES”) WHEN CREATING CONTENT USING GAIJIN'S VIDEOGAMES (“GAME(S)”) PUBLISHED AND/OR LICENSED BY GAIJIN ON ANY PLATFORM (INCLUDING, BUT NOT LIMITED TO, WINDOWS, XBOX, PLAYSTATION, IOS, ANDROID, ETC.) THIS INCLUDES CREATING CONTENT THAT USES GRAPHICAL, AUDIOVISUAL, AND OTHER GAME(S) MATERIALS, INCLUDING LOGOS, GAMEPLAY FOOTAGE, AND SCREENSHOTS (“GAIJIN MATERIALS”). CONTENT CAN INCLUDE, BUT IS NOT LIMITED TO, VIDEO REVIEWS, GAMEPLAY STREAMING, TEXT REVIEWS, AND NOTES (“CONTENT”). CONTENT MUST BE DISTRIBUTED ONLINE VIA STREAMING OR PUBLISHED ON INTERNET PLATFORMS (“PLATFORMS”) AND MADE FREELY AVAILABLE TO THE PUBLIC. GAIJIN RESERVES THE RIGHT TO REMOVE OR REPORT ANY CONTENT THAT, AT ITS SOLE DISCRETION, IS DEEMED TO BE INFRINGING, INAPPROPRIATE, OR ILLEGAL.

Language and Interpretation. The English version of this document is the official version. In case of any differences or disputes regarding interpretation, validity, or form, the English version shall prevail.

1. LIMITATIONS OF USE

1.1. A Creator's use of Gaijin Materials is subject to specific limitations established by Gaijin at its sole discretion. The Creator unconditionally agrees and guarantees that under no circumstances will they (or attempt to) engage in any of the following:

1.1.1. Gaijin’s Official Content. The Creator will not assert or give the impression that the Content is produced or approved by Gaijin or its employees, agents, or other affiliated parties, nor will they claim that Gaijin or its employees, agents, or affiliates otherwise bear responsibility for the Content.

1.1.2. Limited Commercial Use. The Creator will not use the Content, Gaijin Materials, or the Game(s) for commercial gain or any other financial benefit unless specifically allowed by these Guidelines or other documents governing the use of Gaijin Materials (such as affiliate or partnership agreements with Creators).

Important Notice. Gaijin does not restrict the Creator from running advertisements or conducting other profit-generating activities via standard platform monetization systems (for example, YouTube pre-roll ads). However, Gaijin reserves the right to request immediate removal of content that is monetized through any other means not specified in these Guidelines.

1.1.3. No Unauthorized Transmission of Information and Inappropriate Content. The Creator agrees not to post, publish, share, promote, cite, or link to any information or content that:

- Infringes upon the rights of third parties, including intellectual property rights;

- Is offensive, including but not limited to content that is religiously, sexually, racially, or nationally offensive;

- Contains defamatory, abusive, or threatening language;

- Includes nudity or material of a sexual or pornographic nature;

- Is unlawful, deceptive, or fraudulent;

- Invades the privacy of others;

- Contains harassment or promotes, encourages, or incites harassment or excessive violence;

- Encourages or promotes criminal activity, torts, or other offenses, or could lead to civil liability;

- Violates these Guidelines, the End User License Agreement (EULA), the Terms of Service, any other Gaijin policies or agreements, or applicable law.

1.1.4. No Pre-Release Content. The Creator agrees not to create, post, or disclose any unofficially released, unauthorized, or leaked content of any kind in any format. Publishing content that includes material related to any Gaijin Gam(s)e prior to its official release date is strictly prohibited unless it is explicitly authorized by Gaijin.

1.1.5. No extraction of Game(s) Elements. Creators are not allowed to extract materials from the Game(s) (such as voice recordings, music, or in-game objects) and distribute them separately in any form.

1.1.6. No Plagiarism. Creators are not allowed to copy official trailers or create Content based on static in-game images without making a significant creative contribution. Trailer reactions and commentary videos are examples of such creative contributions.

1.1.7. No Usage of Names, Logos, Trademarks, and other Gaijin Designations. Creators are not allowed to use any designations related to the Game(s) (including, but not limited to, the Game(s) title and logo) to distinguish products other than the Game(s), whether for profit or not, without Gaijin’s prior consent. Additionally, Creators are not allowed to register such designations (identical or confusingly similar) as trademarks and/or domain names (including sub-domains) in any country in the world.

1.1.8. No Software Modification. Creators are not allowed to decompile the Game(s) or perform any other actions for which the Game(s) was not originally intended in order to gain access to materials for creating the Content.

1.2. Please note that some Game(s) Content (such as songs, unique models, logos, etc.) may not be owned by Gaijin but instead licensed by third-party artists or authors. Unauthorized use of such third-party content, such as game music, may result in potential video removal by Platforms. If you intend to use any third-party intellectual property, you are solely responsible for obtaining all necessary permissions.

1.3. Any violation of the above guidelines will be considered a breach of Gaijin's rights. Gaijin may contact you, other parties, or Platforms to inform them of the violations, request that you cease distributing the Content immediately, or require you to obtain a license for commercial or other use. Please be aware that the list of limitations provided here is not exhaustive.

1.4. Gaijin does not endorse or support any political parties, groups, movements, organizations, committees, companies, partnerships, corporations, or associations that are organized or maintained for political purposes, nor any candidates for political office. This includes any election, referendum, proposed bill, or any other political activity.

Consequently, Gaijin explicitly prohibits the use of its Game(s) and/or Gaijin Materials for political purposes, as outlined above. The Content must not include any political symbols, logos, attributes, slogans, appeals, statements, or other politically oriented content unless such content is officially added to the Game(s) by Gaijin.

1.5. Permissible use of War Thunder Soundtracks. Creators are permitted to use certain sound recordings (referred to as the “Soundtrack”) from the War Thunder videogame within their Content, subject to the following conditions:

- Creators may only use soundtracks that are uploaded to Gaijin’s cloud-based repository;

- The Soundtrack may only be used in connection with Content related to the War Thunder videogame (e.g., advertisements, videos, or live streams) and may be used either in its original or modified form. Use of the Soundtrack for any other purpose is not allowed; and

- Creators are not allowed to redistribute the Soundtrack as standalone digital files, via physical means, or through any other method not explicitly permitted above (e.g., sharing links to the Soundtrack stored in Gaijin's cloud repository).

2. GENERAL RULES FOR GAIJIN PARTNERS

2.1. Gaijin may enter into a partnership agreement with select Creators (referred to as “Gaijin Content Partner” or “Partners”). If a Creator becomes a Gaijin Content Partner, their Content may include a unique referral link, as outlined in the terms of the partnership agreement.

Under no circumstances may a Creator who is not a Gaijin Content Partner impersonate a Partner, use their individual referral link, or otherwise act as a Partner.

2.2. Gaijin Content Partners must not engage in activities that, in Gaijin’s sole discretion, contradict these Guidelines or violate any principles set forth herein or that may harm (or potentially harm) Gaijin or its Game(s).

For example, Gaijin Content Partners are prohibited from distributing content that promotes xenophobia or misanthropy or encourages illegal activities. This rule applies across all public-facing media, whether related directly to the Game(s) (such as YouTube or Twitch channels) or other platforms (like personal websites or social media).

2.3. Based on complaints or violations of these Guidelines, Gaijin may suspend or terminate a partnership if the Gaijin Content Partner violates Clause 2.2 or any other terms of the partnership contract. This may occur at any time, and Gaijin will not be held liable for any damages resulting from the suspension or termination. If Gaijin chooses to suspend or terminate the cooperation, it will notify the Creator, but no prior notice or justification is required.

3. OTHER PROVISIONS

3.1. Gaijin reserves the right to update these Guidelines at any time in accordance with Clause 11.2 of the Gaijin Terms of Service. Creators should refer to the latest version of the Guidelines before sharing any Content.

3.2. Gaijin may object to any use of its Game(s) or Gaijin Materials and may request the removal of Content that is deemed objectionable at Gaijin’s sole discretion.

3.3. These Guidelines apply solely to individual Creators and do not extend to legal entities, companies, or other organizations of any kind.
