EDENSPARK GAME JAM RULES

These Rules define the terms and conditions governing participation in the EdenSpark Game Jam competition series (“Event”), including the procedure, timing, eligibility requirements, prize structure, and other conditions applicable to Participants.

The Event is an online game development competition in which Participants are invited to create original videogame projects within a limited timeframe based on a specified theme.

KEY TERMS:

• Event is conducted in English;

• participation in the Event is free of charge;

• participants independently bear all costs associated with participation;

• Winners are determined in accordance with the relevant Announcement;

• the Event prize pool (including the quantity and number of prizes) is established in the Announcement;

THE EVENT IS A SKILL-BASED COMPETITION AND IS NOT A LOTTERY OR OTHER GAME OF CHANCE.

1. DEFINITIONS

Announcement” means any official communication published by Organizer regarding a specific Event, including timelines, themes, prize details, and additional conditions.

Creation” means a videogame or other interactive software project developed by the Participant in connection with the Event.

Event Platforms” means EdenSpark.io, itch.io, and official communication channels used by Organizer, including Discord and Telegram.

Organizer” means Gaijin Network Ltd, a Cypriot company with registration number HE 312702 and registered office at 63 Ifigeneias Street, Office 302, Strovolos 2003, Nicosia, Cyprus.

Participant” means any natural person who is at least 18 years old or has reached the age of majority in their jurisdiction and who has accepted these Rules. Participants may participate individually or as part of a team.

Penalty” means any measure imposed by the Organizer in response to a violation of these Rules, at the Organizer’s sole and absolute discretion, consisting of any of the following:

• warning;

• disqualification from the current Event;

• annulment of results;

• ban from participating in future Events;

• exclusion from eligibility for any grand prize; and

• revocation of any granted or grantable prize.

Winner” means a Participant or team selected as a winner in accordance with Section 6 of these Rules.

2. EVENT TERMS AND PROCEDURE

2.1. The Event is conducted entirely online via the Event Platforms, which serve as the primary means for participation, communication, submission, and evaluation of the Creations.

2.2. Each monthly Event constitutes a separate and independent competition. Participation in one Event does not create any entitlement or qualification for participation or success in any other or successive Event.

2.3. Each Event is structured as a time-limited creative challenge, typically involving a development period of approximately 14 calendar days, during which time, Participants are required to design and develop their Creations based on a specified theme. The exact timeline, including the development period, submission deadlines, voting phase, and announcement of Winners, shall be specified in the Announcement and/or communicated via the Event Platforms.

2.4. The Announcement forms an integral part of these Rules and may specify additional eligibility requirements, technical criteria, submission guidelines, prize conditions, and other Event-specific requirements necessary for participation in a particular Event.

2.5. In the event of any inconsistency or conflict between these Rules and the Announcement, the provisions of the Announcement shall prevail with respect to the relevant Event.

2.6. Organizer reserves the right to modify the Event schedule, including development timelines, submission deadlines, voting periods, and announcement dates, where reasonably necessary for the proper conduct of the Event.

3. EVENT PARTICIPATION ELIGIBILITY REQUIREMENTS

3.1. Participation requires:

• registration on EdenSpark;

• registration on itch.io;

• joining the relevant jam page on itch.io;

• joining and remaining subscribed to at least one official communication channel designated by Organizer (e.g., Discord or Telegram), in order to receive Event-related information, updates, and announcements;

• acceptance of these Rules; 

• submission within the deadline set by Organizer; and

• where participating as part of a team, ensuring that all team members are properly registered and, where applicable, listed as co-authors or contributors on the relevant Event Platforms.

3.2. Participation in the Event is additionally subject to the Gaijin Terms of Service and the EdenSpark Terms of Use. In the event of a conflict, these Rules shall prevail to the extent of the Event-specific subject matter, except where expressly stated otherwise.

3.3. Participation is open globally, provided that Participants can receive prizes in compliance with applicable laws, and are not subject to any legal prohibitions that would prevent participation or prize delivery.

3.4. Employees, contractors, affiliates of Organizer, and their immediate family members are not eligible to participate in the Event. For the purposes of this clause, references to such persons include natural persons acting directly or indirectly, including third parties, and persons holding positions such as directors, officers, or similar roles within Organizer or its affiliates.

3.5. Participants may participate individually or as part of a team. Teams may consist of up to a maximum of 10 Participants, unless otherwise specified in the Announcement or by Organizer in writing.

3.6. A Participant may only be part of one team per Event and may not compete both individually and as part of a team in the same Event, or simultaneously in two or more teams.

3.7. Team composition may not be changed after the submission deadline, unless otherwise approved by Organizer.

3.8. All Participants must be properly registered and identifiable. Organizer reserves the right to exercise any appropriate Penalty towards any Participant or team that (a) provides incomplete, false, or misleading information, or (b) fails to comply with registration requirements, including requirements relating to team composition and authorship listing.

4. CREATION REQUIREMENTS

4.1. A valid Creation must:

• be developed during the Event period;

• meaningfully incorporate the Event theme;

• be published on the EdenSpark platform;

• include a completed project page as per the rules below;

• be submitted via itch.io in accordance with the Event instructions;

• be built using the EdenSpark SDK, where required for the relevant Event; and

• be playable or downloadable in a reasonably functional state.

4.2. The Creation must be substantially new and created specifically for the Event. Use of pre-existing materials is permitted only in accordance with Section 4 and provided that such materials do not constitute the core or substantial part of the Creation.

4.3. The following is prohibited:

• submission of pre-existing or previously completed projects;

• resubmission of prior work, in whole or in substantial part;

• minor modifications, reskins, or adaptations of existing works presented as new; and

• any attempt to circumvent the intent of the Event’s originality requirement.

4.4. Participants may use third-party tools, assets, libraries, and AI, provided that they hold all necessary rights, licenses, and permissions for such use, and that such use complies with applicable laws and does not infringe any third-party rights.

4.5. Participants must clearly disclose, at the time of submission, any use of AI, any third-party assets or tools, and any pre-existing elements incorporated into the Creation. Failure to provide accurate and complete disclosure may result in a Penalty.

4.6. Participants are solely responsible for ensuring that their Creation complies with applicable laws, applicable platform rules and policies, and does not infringe any intellectual property or other third-party rights. Without limitation to the above, Creations must not contain content that would violate the rules or policies of any platform on which they may be distributed, published, or streamed, including, but not limited to, Twitch, YouTube, or itch.io. Organizer reserves the right to apply a Penalty in case any Creation does not comply with this Section.

4.7. Each Creation must include a completed project page on the relevant Event Platforms, containing at minimum:

• game title;

• short description;

• “How to play” instructions;

• list of team members;

• disclosure of third-party tools and assets;

• AI usage statement;

• a playable or downloadable build;

• where applicable, an external download link; and

• a link to the corresponding EdenSpark version of the Creation.

5. RESTRICTIONS AND PROHIBITIONS

5.1. Participants must not engage in any conduct that violates applicable laws or these Rules, including, without limitation:, submitting unlawful content, manipulating or attempting to manipulate voting mechanisms, creating or using multiple accounts, misrepresenting authorship or ownership of a Creation, submitting misleading or non-functional builds, or modifying a submitted Creation after the applicable deadline without Organizer’s prior approval, provided that modifications may be made after the conclusion of the Event and the final determination of Winners.

5.2. Any attempt to gain an unfair advantage, circumvent the intent of these Rules, or otherwise undermine the integrity of the Event may result in a Penalty.

5.3. Organizer reserves the right to investigate and determine, at its sole discretion, whether a violation of these Rules has occurred, including whether any conduct constitutes manipulation of voting or evaluation processes, and to determine the appropriate response, including whether to apply a Penalty in light of the circumstances of the case, adjusting results, or taking no action where appropriate in light of the circumstances.

6. WINNER SELECTION AND PRIZES

6.1. Each Event includes a prize pool, which shall be specified in the applicable Announcement.

6.2. A category within an Event shall carry a prize only if expressly specified in the applicable Announcement. Not all categories are necessarily associated with a prize.

6.3. Where an Event includes community voting (e.g., the Community Choice category), the following rules apply, unless otherwise specified in the applicable Announcement:

• only registered Participants of the relevant Event are eligible to vote;

• voting may be restricted to Participants who have submitted a valid Creation or otherwise completed registration requirements;

• Participants may not vote for their own Creation;

• Organizer may impose eligibility criteria for voting, including restrictions based on account creation date, account activity, or other indicators of authenticity;

• votes cast in violation of these Rules may be disregarded, adjusted, or invalidated by Organizer.

6.4. Winners are determined based on the evaluation procedure specified in the applicable Announcement, and may include a combination of organizer review, jury assessment, community voting, or other evaluation methods determined by the Organizer, subject to the restrictions set out in Section 5 of these Rules. In the event of any inconsistency between these Rules and the applicable Announcement, the provisions of the applicable Announcement shall prevail.

6.5. Organizer reserves the right to verify results and to disregard, adjust, or invalidate any votes, submissions, or results that it reasonably suspects to be fraudulent, manipulated, or otherwise in violation of these Rules, including any breach of the restriction set out in Section 5. This includes, without limitation, cases involving vote manipulation, use of multiple or fake accounts, or any attempt to unfairly influence the outcome of the Event.

6.6. All decisions of Organizer in relation to the Event, including Winner selection and prize allocation, are final and binding, unless otherwise provided by these Rules of the relevant Announcement.

6.7. Year-end finalists, if applicable, are primarily selected from monthly Winners. Organizer may, at its sole discretion, also include other Participants or Creations from a given Event that, in Organizer’s opinion, demonstrate exceptional quality, creativity, or potential.

6.8. The year-end total grand prize pool and allocation shall be specified in the applicable Announcement. In addition to any prizes awarded for placements, Organizer may, at its sole discretion, award additional and/or special grants as shall be specified in the applicable Announcement. 

6.9. Organizer reserves the right not to award any prize where, in its opinion, insufficient valid or eligible entries have been received.

7. PRIZE ELIGIBILITY AND IDENTITY VERIFICATION

7.1. Eligibility to receive a prize is conditional upon the Winner’s full compliance with these Rules, successful completion of Organizer’s verification process, and timely provision of all information reasonably requested by Organizer.

7.2. Organizer reserves the right to conduct verification checks and may request, at its discretion, documentation and information, including, without limitation, proof of identity, payment details, confirmation of authorship, and any supporting materials necessary to validate the Creation and the Winner’s eligibility.

7.3. If a Winner fails to complete the verification process or provide the requested information within 90 calendar days from Organizer’s request, the prize may be forfeited at Organizer’s discretion.

8. PRIZES AND PAYMENT

8.1. Prizes are paid by Organizer in accordance with these Rules and subject to successful completion of the verification process described above.

8.2. Where a prize is awarded to a team, payment shall, by default, be made to a single designated representative of the team. Organizer may, at its discretion, permit alternative payment arrangements.

8.3. Organizer bears no responsibility for the allocation or distribution of prizes among team members.

8.4. Organizer reserves the right to delay, withhold, or refuse payment where necessary to comply with applicable laws, regulations, internal policies, or payment provider requirements, including but not limited to sanctions, anti-money laundering, and fraud prevention obligations.

8.5. Organizer may require the designation or substitution of a team representative where reasonably necessary for compliance, payment processing, or verification purposes.

8.6. Prizes are personal to the Winner and are non-transferable, non-exchangeable, and may not be redeemed for any alternative benefit except at the Organizer’s discretion.

8.7. Organizer’s payment obligation shall be deemed fulfilled upon initiation of payment to the designated recipient using the details provided by the Winner.

8.8. Winners are solely responsible for any taxes, duties, or other charges arising in connection with the receipt of a prize, unless otherwise required by applicable law.

8.9. Organizer shall determine the method of payment at its discretion and shall not be obliged to use any specific payment method requested by the Winner.

9. TECHNICAL ISSUES

9.1. The Event Platforms are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.

9.2. To the maximum extent permitted by applicable law, Organizer shall not be liable for any technical failures, interruptions, delays, data loss, or other issues affecting the availability or functionality of the Event Platforms.

9.3. In the event of platform-wide failures, outages, or disruptions that materially affect the conduct of the Event, Organizer may, at its discretion, adjust the Event schedule, including extending deadlines or modifying timelines, as reasonably necessary to ensure fair participation conditions and the proper operation of the Event.

9.4. Technical issues or limitations on Participant’s side, including but not limited to internet connectivity issues, hardware failures, software incompatibilities, or local technical constraints, shall not constitute grounds for deadline extensions, resubmissions, or exceptions.

10. CREATION VERIFICATION AND ENFORCEMENT

10.1. Organizer reserves the right to verify any Creation and Participant compliance with these Rules and may request, at its discretion, supporting materials, including source files, development history, asset lists, and proof of rights.

10.2. If Participant violates any of these Rules, Organizer may, at its sole and absolute discretion, take appropriate Penalty.

10.3. Organizer reserves the right to revise, amend, or invalidate Event results where violations are identified, including after Winners have been announced, including when the Prizes have been granted.

11. INTELLECTUAL PROPERTY

11.1. Participants retain ownership of their respective Creations, subject to the rights granted to Organizer under these Rules.

11.2. By participating in the Event, each Participant grants to Organizer a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual license to use, reproduce, modify, adapt, publish, display, perform, distribute, and otherwise exploit the Creation, in whole or in part, for the purposes of:

• operating, administering, and promoting the Event;

• showcasing Creations across the Event Platforms and related channels; and

• marketing, promotional, and publicity activities of Organizer and its products and services.

11.3. The license granted under this Section applies across all media, platforms, distribution channels, and formats, whether now known or developed in the future.

11.4. Each Participant represents and warrants that:

• they have all the necessary rights to grant the license set out in this Section;

• the Creation does not infringe any intellectual property or other rights of third parties; and

• they shall abide by the indemnification provisions of the Gaijin Terms of Service.

11.5. Where a Creation includes third-party materials, Participant is solely responsible for ensuring that such materials are properly licensed and that Organizer’s use of the Creation as permitted under these Rules does not infringe any third-party rights.

12. FORCE MAJEURE

12.1. Organizer may suspend, modify, or terminate the Event, in whole or in part, in the event of circumstances beyond its reasonable control, including but not limited to technical failures, acts of God, natural disasters, war, terrorism, civil unrest, governmental actions, or disruptions of essential infrastructure.

12.2. To the maximum extent permitted by applicable law, Organizer shall not be liable for any loss, damage, or compensation arising from such suspension, modification, or termination.

13. MISCELLANEOUS

13.1. Participation in the Event constitutes full and unconditional acceptance of these Rules.

13.2. Participation in the Event does not create any obligation on the part of Organizer to enter into any further relationship with any Participant, nor does it guarantee any commercial opportunity, collaboration, or engagement.

13.3. Organizer is not obliged to enter into correspondence with Participants, except where required for the administration of the Event.

13.4. Organizer reserves the right to amend, update, or supplement these Rules at any time. Any such changes shall become effective upon publication via the Event Platforms or other official communication channels.

13.5. Personal data shall be processed in accordance with applicable data protection laws and the Organizer’s Privacy Policy and Privacy Notice for Identity Verification.

13.6. To the maximum extent permitted by applicable law, Organizer shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with participation in the Event.

13.7. Nothing in these Rules shall be construed as creating any partnership, joint venture, employment, or agency relationship between Organizer and any Participant.

13.8. These Rules shall be governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes arising out of or in connection with these Rules or the Event shall be subject to the exclusive jurisdiction of the courts of Cyprus.

13.9. These Rules are drafted in English. In the event of any discrepancy between translations, the English version shall prevail.
