Gaijin Store Policy

IMPORTANT NOTICE: PLEASE READ THIS DOCUMENT CAREFULLY BEFORE ACCEPTING. BY ACCEPTING, YOU CONFIRM THAT YOU HAVE REACHED THE AGE OF 18 OR THE AGE OF MAJORITY IN YOUR JURISDICTION, WHICHEVER IS HIGHER. FURTHER DETAILS ABOUT PERMISSIBLE AGE CAN BE FOUND IN SECTION 8 OF EULA.

Language and Interpretation. The English version of this document is the official version. In case of any differences or disputes regarding interpretation, validity, or form, the English version shall prevail.

Including any real-world weapon or vehicle in the Store does not imply endorsement, sponsorship, or participation in product development by any weapon or vehicle manufacturer.

This Gaijin Store Policy (“Store Policy”) constitutes a legal agreement between you (“User,” “you,” “your) and Gaijin, which refers to: Gaijin Network Ltd, a Cypriot company with registration number HE 312702 and registered office at: 63 Ifigeneias Street, Office 302, Strovolos 2003, Nicosia, Cyprus. 

Gaijin can also be referred to as “we,” “us,” and “our” in this Store Policy.

This Store Policy governs your purchase of in-game items, including but not limited to in-game virtual currency, downloadable content (DLC), characters, skins, and other digital items that enhance or extend your gameplay (“In-Game Items”) for Gaijin’s Game(s). This Store Policy applies to purchases made through the Gaijin.Net Store  (“Store Website”) and other stores owned or operated by Gaijin (including in-app stores). This Store Policy is a part of the Terms and Conditions defined in Gaijin’s Terms of Service.

Before purchasing or using any In-Game Items, you must read and accept this document and other Terms and Conditions, which explain how we provide our Services and process your personal data.

Capitalized terms not defined in this document are defined in the Terms of Service and EULA.

1. PURCHASE OF IN-GAME ITEMS

1.1. To enhance your gaming experience and improve game functionality, you may purchase one or more In-Game Items for our Game(s), regardless of the platform you use. Gaijin reserves the right to refuse or cancel orders for In-Game Items if the order violates the Terms and Conditions or is explicitly prohibited by Gaijin (whether under the Terms and Conditions, on Gaijin’s Website(s), or through other means).

1.2. Certain In-Game Items may only be available only in specific regions. If you reside in a restricted region, you cannot make purchases from the Gaijin Store. Gaijin also reserves the right to adjust prices for specific regions or to set different prices for different areas. 

1.3. Using a VPN or similar technology to manipulate your location for fraudulent purposes is strictly prohibited and constitutes a material breach of this Store Policy and the Terms and Conditions. Gaijin may suspend or delete the User’s Account in case of such a breach.

1.4. Some In-Game Items may be available in limited quantities, depending on the Game(s)’ functionality, and subject to Section 6 of the EULA. 

1.5. In-Game Items are tied to a specific platform (Windows, Xbox, PlayStation, iOS, Android, etc.) where they are purchased and activated. The In-Game Items cannot be transferred between different platforms. Therefore, In-Game Items purchased on one platform will not appear or be usable on another platform.

2. FREE RETRIEVAL AND GIFTS

2.1. Gaijin may distribute promotional In-Game Items through various marketing or promotional activities, where you may receive an activation code or key. These In-Game Items are obtained free of charge, but the rules of the relevant campaign or promotion will govern their use. Users are prohibited from distributing activation codes, keys, or other mediums enabling free retrieval of In-Game Items.

2.2. Users can also purchase the In-Game Items as gifts for other Users. For more details, please refer to the Gaijin Support Q&A.

3. REDEEMPTION PROCESS

3.1. You can only redeem In-Game Items as prescribed by Gaijin in the Gam(e), Store Website, or other official Gaijin channels. Redeeming In-Game Items through unauthorized means is strictly prohibited and constitutes a material breach of this Store Policy and the Gaijin Terms and Conditions.

4. USE OF IN-GAME ITEMS

4.1. The EULA governs the use of In-Game Items. Please pay special attention to Section 6 of the EULA.

5. VIRTUAL CURRENCY

5.1. Virtual currency and other In-Game Items (whether exchangeable within the Game(s) or not) can only be redeemed for other In-Game Items (or in some cases in-game services). Despite its name, virtual currency cannot be redeemed for real-world money, goods, services, or other value (whether from Gaijin or other parties) unless explicitly permitted or required by applicable law.

6. EXPIRATION OF IN-GAME ITEMS

6.1. In-Game Items do not expire unless otherwise specified by Gaijin on the Store Website, another platform, or in the Game(s). The In-Game Items (including virtual currency) may be consumed, spent, or lost during gameplay according to the Game Rules and other Gaijin Terms and Conditions.

7. NO VALUE AND BALANCE CHANGES

7.1. The User acknowledges that In-Game Items have no cash or material value. Gaijin and other parties are not obligated to buy, sell, rent, exchange, or otherwise dispose of In-Game Items for real-world currency or other value, unless expressly authorized by Gaijin or specified in the Terms and Conditions.

7.2. By acquiring a license for In-Game Items, the User gains access to certain digital content and the right to use it within the confines of in-game mechanics. Changes to the characteristics, design, or functionality of In-Game Items should not be interpreted as alterations to their performance, condition, or quality.

7.3. Nothing in this Store Policy can exclude, limit, or alter any mandatory consumer rights granted to you under applicable law. Any provisions that conflict with these legal rights will be considered void and unenforceable, but the remaining provisions of this Store Policy or the Terms and Conditions will still apply.

8. TRANSFER AND JOINT OWNERSHIP

8.1. In-Game Items are non-refundable and may not be sold, transferred, assigned, redeemed, or exchanged for cash unless explicitly permitted by Gaijin. Joint ownership of In-Game Items with another person is prohibited.

8.2. The purchase or sale of In-Game Items or other in-game assets (such as currency, etc.) between Users (“In-Game Transactions”) is strictly prohibited if: 

8.2.1 It involves “real-world” money or other values;

8.2.2 It takes place outside the designated marketplace available within the Game(s);

8.2.3 It qualifies as an Address In-Game Transaction, as defined in Section 8.3 below.

8.3. An “Address In-Game Transaction” refers to any In-Game Transaction where the buyer knows the seller's identity and the seller knows the buyer’s identity (or where the parties involved communicate about the transaction outside of the Game(s). Gaijin reserves the right to classify any In-Game Transaction as an Address In-Game Transaction at its discretion, including through means of automatic decision-making, as long as the transaction meets the criteria defined above.

9. PAYMENT

9.1. All sales are final. Transactions and payments are processed through third-party payment platforms partnered with Gaijin (“Platforms”). Gaijin does not handle your transactions or collect your banking details or any other information related to the transfer of funds. The Platforms are solely responsible for processing transactions, and you are required to comply with their terms and conditions and any other applicable rules or guidelines. Gaijin is not liable for any issues with the payment methods provided by the Platforms. Any disputes or claims regarding the transaction should be directed at the Platforms.

9.2. The price of In-Game Items is set solely by Gaijin and displayed on the Store Website. Prices may vary in different currencies. When processing payments, the Platforms may apply a different exchange rate than Gaijin’s or charge additional fees, which may result in the amount being charged by the Platforms differing from the price shown on the Store Website.

9.3. The purchase of an In-Game Item is finalized immediately once you click the confirmation button to complete the transaction. Please be aware that delays may occur due to technical issues, including those on Platform’s end.

9.4. You have the option to select any payment method offered by the Platforms and supported by Gaijin. All available payment methods will be presented to you during the purchase process. However, Gaijin generally does not provide advice on the specifics of different payment methods. In case of any issues related to payment transactions, you should contact the Platform, not Gaijin. You confirm that you have the right to use the selected payment method and that the transaction complies with applicable laws.

9.6. The personal data associated with your transaction will be processed in accordance with our Privacy Policy. 

10. TAXES AND CHARGES

10.1. You are solely responsible for any applicable taxes, fees, duties, or government charges that may apply in connection with your purchase, use, or other authorized disposal of the In-Game Items. Failure to comply with tax or governmental requirements may result in penalties. Sanctions or, in serious cases, criminal charges.

10.2. In certain situations, Gaijin may collect applicable taxes or other charges from you and remit them to the relevant tax or government authority as required by law, along with any fees charged by the Platforms for their services. For example, the applicable amounts may be charged by Gaijin during your transaction in the Gaijin Store, and such amounts will either be included in the price or clearly outlined to you on the Store Website or in the corresponding invoice.

11. TERMINATION OF EULA OR GAIJIN ACCOUNT

11.1. If your Gaijin Account, EULA, or Terms of Service is terminated, you will lose access to all the In-Game Items purchased or otherwise obtained, including unused items. For more information on termination, please refer to Section 12 of the EULA and Section 3 of the Terms of Service.

12. ERRONEOUS INFORMATION AND TRANSACTIONS

12.1. In the event of a technical or other error, including but not limited to errors in pricing, description, order confirmation, order processing, delivery, or the functioning of any In-Game Item, Gaijin reserves the right to correct such errors. If necessary, Gaijin may revise your order accordingly (including correcting the description or price) or cancel the order entirely.

13. REFUND POLICY

13.1. In the case of definitely and unconditionally faulty or non-functioning In-Game Items, or in other instances where you are entitled to a refund under applicable law, we will process the reimbursement using the same payment method as the original transaction. This will occur unless we decide to address the issue by patching the In-Game Item, as outlined in Section 12 of this Store Policy. To request a refund, please contact Gaijin Support Service at support.gaijin.net.

14. EU AND UK RIGHT OF WITHDRAWAL

14.1. Customers in the European Union and the United Kingdom have the right to withdraw from certain transactions under EU harmonized legislation. However, for purchases made through the Gaijin Store, you lose your right to withdraw after you begin using (or downloading, if applicable) the item.

IMPORTANT: BY ACCEPTING GAIJIN’S TERMS AND CONDITIONS, INCLUDING THIS STORE POLICY, YOU EXPLICITLY ACKNOWLEDGE, AGREE, AND CONSENT THAT YOUR RIGHT TO WITHDRAW FROM THE IN-GAME ITEM YOU PURCHASED WILL EXPIRE IMMEDIATELY UPON STARTING ITS USE (OR DOWNLOAD IF APPLICABLE).

14.2. To exercise your right to withdraw, you must notify Gaijin by providing an unambiguous statement of your intention. You can do that by contacting our Support Service at support.gaijin.net. We will promptly assess your request and respond within a reasonable timeframe to discuss the circumstances and grounds for your withdrawal.

14.3. Exceptions from the right to withdraw. Under EU harmonized legislation (and UK laws), you are not entitled to a refund in the following cases (the list is not exhaustive and applies specifically to the Gaijin Store):

14.3.1 In-Game Items that are inseparably mixed with other In-Game Items or the Game(s) itself;

14.3.2 In-Game Items are made to the User’s specifications or are clearly personalized; and/or

14.3.3 You have already started using (or downloading, if applicable) the In-Game Item.

15. AUSTRALIAN CONSUMER RIGHTS

15.1. In-Game Items are subject to guarantees under the Australian Consumer Law that cannot be excluded.

If you are a resident of Australia, you are entitled to a refund or replacement for In-Game Items that fail to meet acceptable quality standards under the Australian Consumer Law as outlined below. Please note that you are not entitled to a refund or replacement if you simply change your mind about your purchase.

15.2. You are entitled to have In-Game Items repaired or replaced if they fail to meet acceptable quality standards and the failure does not constitute a major failure. If there is a major failure, you are entitled to a replacement or refund, along with compensation for any other reasonably foreseeable loss or damage. Any limitations, warranties, or liability apply only to the extent permitted by the Competition and Consumer Act.

15.3. A major failure occurs when:

15.3.1 You would not have purchased the In-Game Item had you been aware of the problem;

15.3.2 The item significantly differs from its description or fails to meet reasonable expectations for that type of digital content;

15.3.3 The item is unfit for its ordinary purpose and cannot be easily fixed within a reasonable time; and/or

15.3.4 The item creates an unsafe situation.

16. MISCELLANEOUS

16.1. For any matters not explicitly addressed in this Store Policy regarding the purchase, use, or disposal of In-Game Items and the functioning of the Gaijin Store, the relevant provisions of the Terms of Service and the EULA will apply. These may include but are not limited to governing law and jurisdiction, warranty disclaimers, indemnification, updates and modifications, severability, assignment, and termination.
