Gaijin General Rules for Promotional Events

IMPORTANT NOTICE. PLEASE READ THIS DOCUMENT CAREFULLY BEFORE ACCEPTING, AND MAKE SURE YOU HAVE REACHED THE AGE OF 18 OR THE AGE OF MAJORITY IN YOUR JURISDICTION, WHICHEVER IS HIGHER. YOU CAN FIND OUT MORE DETAILS ABOUT PERMISSIBLE AGES AND OTHER REQUIREMENTS FOR PARTICIPATION IN THE EVENT IN SECTION 3 OF THIS DOCUMENT BELOW. 

Language and Interpretation. The English version of this document is the official version. In case of any differences or disputes regarding interpretation, validity, or form, the English version shall prevail.

These General Rules for promotional, advertising, and marketing, events organized by Gaijin ("Promo Rules" and “Events” respectively) constitute a legal agreement between You (“Participant”, “you”) and Gaijin Network Ltd, a Cypriot company with registration number HE 312702 and registered office at 63 Ifigeneias Sreet, Office 302, Strovolos 2003, Nicosia, Cyprus. (“Gaijin”) which can also be referred to as “we,” “us,” or “our” in this document.

Participation in each Event is governed by these Promo Rules unless otherwise explicitly stated by Gaijin. By participating in an Event, you agree to be legally bound by these Promo Rules.

CERTAIN LAWS AND REGULATIONS MAY APPLY. PLEASE REFER TO SECTION 12 BELOW FOR MORE DETAILS.

NO PURCHASE IS NECESSARY TO ENTER OR WIN UNLESS OTHERWISE EXPLICITLY STATED IN THE ANNOUNCEMENT (AS DEFINED BELOW). A CONTRIBUTION OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. GENERAL INFORMATION AND DEFINITIONS

  1. For the purposes of these Promo Rules, the following terms shall have the meanings specified below:

“Announcement” refers to any terms, rules, messages, or other information published by Gaijin regarding the Event, including the invitation to participate. Such an Announcement is considered an integral part of these Promo Rules.

“Game(s)” refers to any of the videogames, including downloadable content (DLC), expansions, updates, patches, and any other content published and/or licensed by Gaijin under an End User License Agreement (EULA) for use by Users on any platform (e.g., Windows, Xbox, PlayStation, iOS, Android, etc.) whether accessed by digital download, physical media, or other distribution methods.

“Participant” refers to any person eligible to participate in the Event according to these Promo Rules and the Announcement and has started participating in the Event and is also referred to as “you” in these Promo Rules.

“Partner” refers to an organization Gaijin works with to organize the event. The specifics of their involvement may be outlined in the Event Announcement or elsewhere.

“Platform” refers to any online platform, such as Twitch (twitch.tv), YouTube (youtube.com), or any other website or non-internet venue where the Event takes place.

“Prize” refers to any reward or gift offered in the Event as outlined in Section 5 below.

“Unfair Advantage” refers to any unlawful, dishonest, or other unethical actions used to gain advantage in the Event, including deception, forgery, blackmail, coercion, abuse, misuse of data, or any other attempts to circumvent these Promo Rules.

1.2. Gaijin reserves the right, in its sole discretion, to modify, amend, vary, or waive any of these Promo Rules or the Announcement in the future without prior notice of the change. Any such changes will be communicated in the same manner as the original Promo Rules or Announcement.

1.3. The Event is neither endorsed nor sponsored by any entity other than Gaijin and the Partner(s) specified in the Announcement or otherwise designated by Gaijin.

1.4. Gaijin may collaborate with one or more Partners to organize and conduct an Event.

1.5. The Event's primary purpose is to promote the Game(s) mentioned in the Announcement or Gaijin’s Service(s) unless otherwise specified in the Announcement.

1.6. Any violation of the rules outlined in the Announcement will also be considered a breach of these Promo Rules.

1.7. Gaijin reserves the right to restrict the number of Participants, teams, and/or team members eligible for the Event. 

2. EVENT DURATION

2.1. Gaijin will outline the specific terms for each Event in the relevant Announcement. 

2.2. Gaijin reserves the right to modify the following: 

- The Event’s starting date - no later than 1 calendar day before the scheduled initial start (or the most recent start date);

- The Event’s end date - at any time, at Gaijin’s sole discretion, while considering the applicable laws outlined in Section 12 below.

3. ELIGIBILITY FOR PARTICIPATION

3.1. Gaijin will specify the registration and eligibility terms and conditions for each Event in the relevant Announcement. The provisions outlined below apply to all Events unless explicitly stated otherwise in the Announcement.

3.2. To be considered a Participant, you must meet the following eligibility criteria:

- Be at least 18 years old or have reached the age of majority in your jurisdiction, whichever is higher, to be able to legally agree to these Promo Rules;

- Agree to comply with Gaijin’s Terms and Conditions (“Gaijin T&Cs”), which take precedence over these Promo Rules. These include Gaijin’s Terms of Service and Privacy Policy; and

- Adhere to the Rules of Conduct according to Section 8 of these Promo Rules. 

3.3. Username Limitations. The username used by a Participant must not: 

- Include or be associated with the names of Game(s), Gaijin, or any trademark, trade name, or logo owned or controlled by Gaijin.

- Impersonate another Participant, influencer, streamer, celebrity, government official, Gaijin or Partner employee, or any other individual or entity, or their representative.

3.4. Other Requirements. The following conditions and limitations shall apply to the Event and Participants: 

- Employees of Gaijin, Partner organizations, or any other companies associated with the Event (including affiliates, subsidiaries, advertising, promotion agencies, and suppliers) and their immediate family members (spouse, parents, siblings, and children) or those residing in the same household are not eligible to participate in the Event;

- Participants may only use one account (whether a Platform account, Gaijin Account, or otherwise) to participate.  The use of multiple accounts is strictly prohibited;

- Violating any of the rules set forth in these Promo Rules (including but not limited to the Rules of Conduct in Section 8 below) may result in disqualification from the Event or forfeiture of the Prize;

- Each Participant is responsible for all expenses related to their participation in the Event, including but not limited to internet service costs;

- Gaijin may, at its sole discretion, determine whether any eligibility requirements have been met or not and may require evidence or confirmation from Participants prior to awarding the Prize;

- A Participant who enters or attempts to enter the Event fraudulently or unfairly, including but not limited to tampering with the competition, cheating, hacking, deception, other forms of Unfair Advantage or engaging in any actions designed to annoy, abuse, threaten or harass any other Participants, Gaijin or its Partner or their agents or representatives, may be disqualified at Gaijin’s sole discretion.

3.5. Additional Entry Rules. Gaijin may introduce additional entry rules or requirements in the Announcement or other publications, which will be made available in the same manner as the Announcement or these Promo Rules.

4. LIMITATIONS AND RESTRICTIONS

4.1. While participating in the Event, the Participant is strictly prohibited from publishing, distributing, or otherwise communicating with the public (including other Participants) through the Event and/or Platform (directly or indirectly), any information that:

4.1.1. Violates any applicable rules on the Platform.

4.1.2. Contains any of the following:

- Threats, blackmail, or any other forms of coercion or manipulation.

- Vulgar, obscene, or otherwise inappropriate content for the Event.

- Obscene or otherwise inappropriate language, pornographic material, or other sexually explicit materials.

- Cruelty or violence, including harm toward humans or animals.

- Descriptions of suicide or methods of inducing it.

- Extremist or other illegal materials.

- Confidential information, state or commercial secrets, or other restricted information, including, without limitation, private details of third parties.

4.1.3. Promotes the use or distribution of drugs, controlled substances, or any information related to their illegal production and distribution.

4.1.4. Promotes racial, religious, ethnic, or other forms of hatred or enmity, promotes criminal activity, or includes advice, instructions, or guidance for committing criminal acts. and/or

4.1.5. Discredits, insults, or disparages third parties, including other Participants, or otherwise harms the honor, dignity, or business reputation of others.

4.2. Gaijin, at its sole discretion and without limiting its other rights, may limit, suspend, or terminate the participation of any Participant under certain circumstances. Specifically, Gaijin has the right to take the following actions:

- Refuse to award a Participant who has failed to comply with these Promo Rules or has breached them;

- Suspend a Participant from participating in the Event at any stage if Gaijin reasonably suspects that the Participant (or a third party acting on the Participant’s behalf, either directly or indirectly) has gained or is attempting to gain an Unfair Advantage within the Event;

- Invalidate a Participant’s participation in the Event if Gaijin determines that the Participant has gained or attempted to gain an Unfair Advantage, or on any other grounds as provided by these Promo Rules, the Announcement, or applicable law.

4.3. Gaijin reserves the right not to engage in written negotiations or other communications with Participants, except in cases outlined in these Promo Rules or when applicable law requires.

4.4. THE PARTICIPANT ACKNOWLEDGES THAT GAIJIN IS NOT RESPONSIBLE FOR THE ACTIONS OR OBLIGATIONS OF PARTNERS AND/OR OTHER THIRD PARTIES IN CONNECTION WITH THE EVENT. THE PARTICIPANT MAY ONLY REQUEST THE PERFORMANCE OF OBLIGATIONS DIRECTLY ATTRIBUTABLE TO GAIJIN OR A PARTNER SOLELY UNDER THESE PROMO RULES OR ANNOUNCEMENTS.

5. WINNER SELECTION AND PRIZES

5.1. Gaijin will outline the procedure for selecting the winner of each Event in the relevant Announcements.

5.2. The Prizes are awarded "AS IS" and without any warranty, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

5.3. Please note that if the Partner is responsible for providing the Prizes, as stated in the relevant Announcement, Clause 4.4 of these Promo Rules will apply without exception. 

5.4. There are no alternative Prizes available. The right to the Prize is non-transferable. If Gaijin cannot provide the specified Prizes due to circumstances beyond its control, Gaijin reserves the right to offer substitute Prizes of equal value. Prizes in the form of services or entitlements may not be sold or transferred under any circumstances. 

5.5. Any taxes and costs associated with receiving the Prize are the responsibility of the winner, except for the cost of sending any prize money. For clarity, this provision does not relieve the awarding party from complying with mandatory taxation rules stipulated by applicable laws.

5.6. The Participant cannot request the monetary equivalent of a non-monetary Prize or transfer the right to the Prize to another person.

5.7. For the delivery of the Prize (including funds transfer), Gaijin has the right to request necessary information and documents from the Winner. Such information may include:

- First name, last name, patronymic (if applicable);

- ID (or passport) number, a photocopy of it, or information contained within it;

- Place of permanent or temporary residence;

- Delivery address;

- Bank account details.

The information must be provided within the timeframe and manner specified by Gaijin or its Partner. Failure to provide the requested information may result in the Participant losing their right to receive the Prize.

5.8. If a Participant eligible for a Prize breaches any provisions of these Promo Rules, the Announcement, or other rules governing their participation in the Event, including those related to claiming the Prize, they will forfeit their right to receive the Prize. In such a case, Gaijin or the Partner may:

- Redistribute the Prize among other winners.

- Award the Prize to Participant(s) who were not previously eligible but achieved the best results in the Event. or

- Cancel the Prize entirely and not award any Participant.

5.9. If a team (group) of Participants wins a Prize, the Prize should be shared equally among the team members or distributed as fairly as possible. No Participant may transfer their rights to the Prize to another team member, except as specified in the Announcement. Additionally, no Participant has the right to claim the Prize on behalf of a teammate, even if the Prize is unclaimed by that teammate.

6. AWARDING THE PRIZE

6.1. Winners will be notified about their Prize via the email address they provided. Gaijin is not responsible for the winner not receiving the notification due to security settings, incorrect contact information, or absence. If the winner does not respond within 90 calendar days, they may forfeit the Prize, and an alternate winner may be selected based on leaderboard placement.

6.2. If the winner cannot accept the Prize within 90 calendar days for any reason, they will lose the right to receive it. However, Gaijin may, at its sole discretion, extend this period.

7. TECHNICAL ISSUES

7.1. Due to the nature and scale of online competitions, the Event will not be restarted or cancelled due to bugs, intentional disconnections, server crashes, or accidental disconnections.

8. RULES OF CONDUCT: GENERAL PROVISIONS

8.1. All Participants must act with personal integrity, honesty, and good sportsmanship, according to the rules outlined in this Section. 

8.2. Participants are expected to treat other Participants, visitors to the Platform, and everyone involved in the Event with respect.

  1. Participants must not engage in behavior that is:

- Contrary to these Promo Rules;

- Disruptive, unsafe, or destructive;

- Harmful to the enjoyment of the Event by others, or that affects their experience as intended by Gaijin. Participants shall not harass, use abusive or offensive language, sabotage the Game(s), spam, social engineer, scam, or participate in any unlawful activities.

  1. Additionally, Participants must not:

- Claim to be a banned player or falsely present themselves as someone who breaks the rules, including Gaijin’s T&Cs and the Game Rules;

- Glorify or promote the violation of these Promo Rules in any way. 

8.5. Any breach of these Promo Rules or Gaijin’s T&Cs may result in disqualification from the Event, regardless of whether the violation was intentional or not.

8.6. Participants must not engage in any form of harassment, abuse, or discriminatory behavior based on race, color, ethnicity, nationality, religion, political beliefs, gender, gender identity, sexual orientation, age, disability, or any other characteristic protected by applicable laws, regulations or agreements (e.g., YouTube Guidelines, Twitch Terms and Conditions, and/or Gaijin’s T&Cs).

9. GAIJIN’S USE OF ENTRIES

9.1. By entering the Event, each Participant grants Gaijin and its Partners a perpetual, non-exclusive, worldwide license to use all materials submitted as part of the Event (including the Participant's name, address, likeness, and statements about the Event and Prize), for any publicity, advertising and promotional purposes without any compensation, unless such is prohibited by law. Participants also release Gaijin and its Partners from any liability related to using these materials.

10. RELEASE AND WAIVER

10.1. By participating in this Event, you agree to release Gaijin, its Partners, and their respective parent companies, subsidiaries, affiliates, directors, officers, employees, and agencies from any liability, and waive any claims, costs, injuries, losses, or damages of any kind arising from or in connection with the Event including delivery, mis delivery, acceptance, possession, use of, or inability to use any Prize. This includes but is not limited to personal injuries, death, property damage or destruction, invasion of privacy, defamation, or portrayal in a false light, whether intentional or unintentional. This release applies to all legal claims, including those based on contract, tort (such as negligence), warranty, or other legal theories. It extends to any activities related to the Event, interactions with Event materials, or errors in Event-related documents.

10.2. EVERYTHING PROVIDED IN CONNECTION WITH THE PROMOTION IS OFFERED "AS IS" WITHOUT ANY WARRANTIES, EITHER EXPRESSED OR IMPLIED. THIS INCLUDES BUT IS NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSES, OR NON-INFRINGEMENT.

10.3. Some jurisdictions may not allow the exclusion of implied warranties or statutory rights, so the above exclusions and limitations may not apply to you in some instances.

11. PRIVACY

11.1. Gaijin collects personal data about Users and Participants in accordance with its Privacy Policy, which is available at https://legal.gaijin.net/privacypolicy. Gaijin only collects data necessary for fulfilling its contractual obligations or has another valid legal basis for processing your data.

11.2. BY PARTICIPATING IN THE EVENT, YOU ACKNOWLEDGE THAT GAIJIN AND ITS PARTNERS MAY CONTACT YOU TO DELIVER ANY PRIZE SHOULD YOU WIN AND MAY PROCESS YOUR PERSONAL DATA (SUCH AS YOUR ADDRESS AND OTHER CONTACT DETAILS, LIKE EMAIL AND PHONE NUMBER) FOR THIS PURPOSE.

Additionally, the Partners may collect some of your data independently under their own privacy policies, notices, or statements.

12. LEGAL ENFORCEMENT

12.1. If any federal, state, municipal, or other applicable laws and regulations directly affect the Event, its organization, or participation, these Promo Rules will be interpreted and enforced as necessary to comply with such laws and regulations.

13. MISCELLANEOUS

13.1. For any matters related to the participation in the Event that are not explicitly covered by these Promo Rules, including but not limited to governing law and jurisdiction, warranty disclaimer, indemnification, updates and modification, severability, assignment and termination, the relevant provisions of Gaijin’s Terms of Service will apply to these Promo Rules.
