Copyright Compliance Policy
Gaijin understands the importance of respecting intellectual property rights. The Contribution Agreement ("Agreement") explicitly prohibits Users from submitting any User-Generated Content that infringes on the copyright, trademark, patent, trade secret, or any other intellectual property rights, privacy rights, or other legal or moral rights of third-party individuals or entities. Gaijin may remove any User-Generated Content that infringes on a third-party’s rights upon receiving a valid request as outlined below.
This Copyright Compliance Policy is part of the Agreement and provides a precise copyright infringement dispute resolution mechanism. Any terms not defined in this Copyright Compliance Policy will have the meanings given to them in the Agreement. The Agreement and this Copyright Compliance Policy are legally binding on all Users.
Please be aware that reviewing the following notices and requests may involve processing your personal data in accordance with the Gaijin Privacy Policy.
1. RIGHTSHOLDER’S AUTHORIZATION
Under Article 17 of the Directive on Copyright in the Digital Single Market (EU 2019/790), if you wish to inquire about granting authorization for using your copyrighted work uploaded by Users, please contact Gaijin by email at legal@gaijin.net. Gaijin will review your inquiry and respond promptly.
Your inquiry should include the following information:
- Your full name;
- Name of the copyright owner;
- Your email address;
- Your physical address;
- Your phone number;
- Your relationship to the copyright owner (e.g., whether you are the copyright owner, a representative, etc.);
- Evidence of rights and authorization (e.g., registration certificate, license agreement, power of attorney, signed letter on your organization’s letterhead, or other relevant materials);
- A description of the copyrighted work(s) and the location of the material you wish to authorize (including additional identifying information such as URLs, if applicable);
- A detailed description of what you wish to authorize and how many individual pieces of content you would like to authorize;
- A confirmation that the information you provided is accurate and that you are the legitimate copyright owner or authorized to act on behalf of the copyright owner;
- Your electronic signature (e.g., your name)
2. RIGHTSHOLDER’S RIGHT TO MAKE THE WORK UNAVAILABLE
As a legitimate rightsholder, you may request that your copyrighted work, submitted as User-Generated Content by Users, be prohibited (made unavailable). Before submitting such a request, please consider whether fair use, fair dealing, or a similar exception to copyright applies. When Gaijin receives and validates a proper request, we will promptly remove or restrict access to the material claimed to be infringing or subject to infringement activity.
To process your request, it must be sent to: legal@gaijin.net and should include the following information:
- Your full name;
- Name of the copyright owner;
- Your email address;
- Your relationship with the copyright owner (e.g., whether you are the copyright owner, a representative, etc.);
- Evidence of rights and authorization (e.g., registration certificate, license agreement, power of attorney, signed letter on your organization’s letterhead, or other relevant materials);
- A description of the copyrighted work(s) that you claim is infringed (e.g., image, music, photo, etc.), along with a description of where the allegedly infringing material is located (including additional identifying information such as URLs to assist in finding the infringing material);
- Your confirmation that the provided information is accurate and that you are the legitimate copyright owner or authorized to act on behalf of the copyright owner;
- Your confirmation that you understand there may be legal consequences for making false or bad-faith allegations of copyright infringement using this process;
- Your electronic signature (e.g., your name).
Please note that incomplete requests may limit our ability to process them. In such cases, Gaijin will contact you to provide the missing information. Failure to provide the necessary details may result in the denial of your complaint.
IMPORTANT NOTICE. EU LAW PROVIDES EXCEPTIONS AND LIMITATIONS TO COPYRIGHT, INCLUDING USES FOR QUOTATION, CRITICISM, REVIEW, AND PURPOSES SUCH AS CARICATURE, PARODY, OR PASTICHE. SOME EU COUNTRIES MAY OFFER ADDITIONAL EXCEPTIONS OR LIMITATIONS. AS A RIGHTSHOLDER, YOU ACKNOWLEDGE THAT GAIJIN IS REQUIRED TO RESPECT AND UPHOLD USER EXCEPTIONS AND LIMITATIONS TO COPYRIGHT.
Below are some of the key exceptions and limitations to copyright under EU law:
Quotation, criticism, and review. A quotation involves using an extract from a copyrighted work to illustrate an assertion, defend an opinion, or make an intellectual comparison with the work. Quotations may be used for criticism or review.
Caricature, parody, and pastiche. These creative uses include parody (creating a new work for humor or mockery using an existing work), caricature (simplifying or exaggerating a subject), and pastiche (combining selections from multiple sources that imitate other styles).
Please ensure that:
Using quotations does not exceed what is necessary to achieve your purpose.
- The material used is publicly available.
- Your use of the material is fair and does not unduly harm the legitimate interests of the rightsholder.
- Where practical, the use of the material is accompanied by appropriate acknowledgment.
3. USERS’ COUNTER-NOTIFICATION
Gaijin reserves the right to remove or disable User-Generated Content subject to alleged infringement of a third party's intellectual property rights. The User who posted such material will be notified promptly. However, the User may file a Counter Notification if they reasonably believe that the User-Generated Content is not infringing.
To process a Counter Notification request, it must be sent to legal@gaijin.net and should include the following information:
- Your full name;
- Your email address;
- Your phone number;
- Your physical address;
- The name of your Gaijin Account;
- Your name, as listed on the WT Live website;
- A description of the material that was removed or disabled and where the material was located before it was removed or disabled;
- Your status (e.g., whether you are the User who posted the infringing User-Generated Content or an authorized representative of the person who posted the content);
- Your confirmation that you understand there may be legal consequences for making false or bad-faith allegations using this procedure.
Failure to include the necessary information may limit Gaijin’s ability to process your counter-notification. In such cases, Gaijin will request the missing details from you. The lack of required information may result in the denial of your complaint.
If it is determined that the alleged User-Generated Content does not violate this policy and Gaijin restores the material, the party who originally submitted the removal request will be notified without delay.
The User has the right to request updates on the progress of their inquiry, request, or counter-notification at any time.
